Commissioners Minutes July 6, 2021
Commissioner Bud Motsinger called the meeting to order at 8:30 am in the commissioner’s room of the Courthouse with County Clerk Christine Owen. Roll call: Bud Motsinger-present; Rex Hibler- present; Jonathan Abbott-absent. They opened the meeting with the Pledge of Allegiance. Commissioner Motsinger moved to approve the agenda and Commissioner Hibler seconded, roll call vote as follows; Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott was absent. Commissioner Hibler moved to approve the June 28 meeting minutes and the June 28 closed meeting minutes. Seconded by Commissioner Motsinger. A roll call vote was taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott was absent.
Weekly bills were paid.
Commissioners met with Jeff Campbell, Road and Bridge supervisor to discuss the flooding in the county and if the construction of the new bridge was damaged. Also discussed progress on John Deere Bridge.
Commissioners met with Jerry Burchett regarding a brush letter.
Commissioner Motsinger moved to send certified brush letter to Kingston Township Section 35 SE Quarry Road. Seconded by Commissioner Hibler and a roll call vote taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott was absent.
Commissioner Motsinger moved to transfer $56,000 from General Revenue to Assessment Fund per the 2021 budget. Seconded by Commissioner Hibler and a roll call vote taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott was absent.
Clerk Owen gave the commissioners the Financial Disclosure Resolution No. 2021-07-12 for approval next week.
Clerk Owen presented the commissioners with the expenditures through June 30, 2021 including percentage of budget remaining for all departments.
Commissioners met with Mike Ryan of Creative Planning to discuss the liability insurance for the county.
Commissioners reviewed questions for the State Auditor Rick Stuck.
Commissioners called Attorney Travis Elliott with questions about the ARPA funding and the policies that need to be in place before funds are expended.
Commissioners reviewed the ARPA Summary of Treasury Compliance and reporting guidance for State and Local Fiscal Recovery Funds provided by the American Rescue Plan Act (ARPA).
Commissioners returned a call to Cathy Youtsey regarding questions about the Little Otter Creek bids.
Commissioners met with Recorder Julie Hill in her office.
Commissioners met with Assessor Beverly Alden and discussed the upcoming Board of Equalization.
Commissioners met with Assessor Beverly Alden and Collector/Treasurer Beth Larkins about courthouse items.
Commissioners returned a call to Lou Ann Kepner and left her a voice mail about her question.

Commissioner Bud Motsinger called the meeting to order at 8:00 am in the breakroom of the Caldwell County Courthouse with County Clerk Christine Owen. Roll call: Bud Motsinger; present Rex Hibler; present Jonathan Abbott; present.
Commissioners met with Assessor Beverly Alden, Collector/Treasurer Beth Larkins and Recorder Julie Hill.
Commissioner Abbott moved to go into Closed Session per RSMO 610.021(3) personnel. Commissioner Hibler seconded. A roll call vote was taken; Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.

Commissioners will met on the site of the proposed AOP site on Toledo Road with landowner at 10 AM with Greg Pitchford of Allstate.

Commissioner Bud Motsinger called the meeting to order at 8:30 am in the commissioner’s room of the Caldwell County Courthouse with County Clerk Christine Owen. Roll call: Bud Motsinger; present Rex Hibler; present Jonathan Abbott; present. Commissioner Hibler moved to approve the agenda and Commissioner Abbott seconded. A roll call vote was taken; Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.
Payroll was signed.
Commissioners met with FEMA & SEMA to discuss flooding issue within the county. Township board members also attended.

Commissioner Hibler moved to approve the amended agenda and Commissioner Abbott seconded, roll call vote as follows; Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea. Commissioner Hibler moved to approve the July 6, 8 & 9 meeting minutes and the closed session minutes on July 8. Seconded by Commissioner Motsinger. A roll call vote was taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.
Weekly bills were paid.
Commissioners received a phone call from Carl Sneed to discuss a culvert on Soo Line Road that was washing out.
Commissioners met with Jeff Campbell, Road and Bridge supervisor. They discussed culvert on Soo Line Road, LOC crop ground, drainage on Panther Road and brush letters. Jeff shared an employee application that he received.
Commissioners opened bids for brush removal in Grant Township Section 2, SE Tobin Valley Dr & Section 23, SE Royals Rd. No bids were received for Grant Township, Section 23 SE Royals Road. A bid from Jim Anderson was received to remove brush, haul away and treat stumps on Grant Township, Section 2, SE Tobin Valley Drive for $4,200. The landowner will be notified of the bid amount and have 2 weeks to respond.
Commissioners discussed a Memorandum of Understanding (MOU) with ACCD-911 concerning the application for a grant.
Commissioner Motsinger moved to adopt the Financial Disclosure Resolution No. 2021-07-12-2021 Code of Ethics, State of Missouri, County of Caldwell. Seconded by Commissioner Hibler. A roll call vote taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.
Commissioner Abbott stepped out to take a phone call.
Commissioners met by video Zoom call with Allstate Engineers regarding the progress on the Little Otter Creek Reservoir.
Commissioner Abbott returned to the meeting.
Commissioner Abbott moved to have Presiding Commissioner Motsinger sign a letter of engagement with Williams & Campo, P.C. regarding services from Padraic Corcoran on legal matters relating to the Little Otter Creek Reservoir Project and other matters as requested by Attorney Ed Proctor. Seconded by Commissioner Hibler. A roll call vote taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.
Commissioners discussed an endorsement for pandemic coverage from MOPERM.
Commissioners met with Terry Rumery to discuss economic development for the county.
Commissioner Motsinger signed a management representation letter regarding the completion of field work for the audit ending December 31, 2020 by the Missouri State Auditor’s Office.
Commissioners asked Clerk Owen not to attend a meeting that the commissioners had in the breakroom of the courthouse with Recorder Julie Hill, Assessor Beverly Alden, Collector/Treasurer Beth Larkins to discuss pay raises the elected officials gave to their employees without commissioners consent.
Commissioners reviewed the BOE schedule for next week. Citizens have until today at 5:00 PM to call for a hearing.
Commissioner Motsinger moved to allow road and bridge to purchase a camera to take pictures of road brush to accompany brush letters to clarify to landowners what need to be cleared. Commissioner Abbott seconded and a roll call vote was taken; Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.
Commissioners received a call from Linda McElwee to discuss concerns of the Public Service Commission granting Grain Belt Public entity rights.

Commissioners and Clerk Owen participated in a Zoom video meeting with Attorney Ed Proctor, Attorney Padraic Corcoran; Allstate Consultants Cary Sayre, Julie Marks and Greg Pitchford.
Commissioner Hibler moved to go into closed session per RSMO 610.021 (1) Legal. Seconded by Commissioner Motsinger. Roll call vote taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott was absent.

Commissioners talked with Assessor Beverly Alden regarding the upcoming BOE.

Commissioner Abbott arrived at 8:35AM.
Commissioners met with Jeff Campbell, Road and Bridge supervisor to discuss construction on Galloway bridge deck. Jeff had a job application for the position at road and bridge to discuss.
Commissioners met with Michael Marriott, MoDOT NW district area engineer to discuss the speed study for Old 36 Highway and the maintenance agreement with MODOT for Old 36 Highway.
Commissioners returned a call to Judge Jason Kanoy regarding community service hours that could be served at the courthouse.
Commissioners reviewed an AOP site plan for the bridge design on Toledo Road.
Commissioner Hibler moved to approve the July 12, 14, & 15 open meeting minutes. Seconded by Commissioner Abbott. A roll call vote was taken as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.

Commissioners called Attorney Padraic Corcoran to set up a closed session meeting for tomorrow concerning county litigation.
Commissioners attended the LEPC meeting at Health Department.
Commissioners attended the Caldwell County Foundation meeting at the library.

Commissioners had a phone call from Justin Pollard regarding brush in Mirabile and Rockford Township.
Commissioner Bud Motsinger called the 2021 Caldwell County Board of Equalization to order.
Commissioners Bud Motsinger, Jonathan Abbott and Rex Hibler met in the commissioner’s room of the Caldwell County Courthouse with County Clerk Christine Owen, Assessor Beverly Alden, John Saccaro & Leroy Kern for the Board of Equalization appeal hearings. The following Board of Equalization appeal were held: David McEwen, Parcel number 04-1-1-1-05-1.00 at 912 3rd St, Kidder, MO 64649.
The Caldwell County Board of Equalization is hereby adjourned for 2021.
Commissioners reviewed the Burns & McDonnell invoice for the design phase for payment for the Federal-Aid Project BRO-B013(40) Bridge No. 37200051 on John Deere Rd. Commissioner Motsinger moved to pay the Progress Inv. No. 8 for $8,053.25. Commissioner Abbott seconded. A roll call voted was recorded as follows: Bud Motsinger voted yea; Rex Hibler voted yea; Jonathan Abbott voted yea.

Commissioners met with Jeff Campbell, Road and Bridge supervisor. Galloway Bridge was completed, and they have been working on Little Otter Creek house and cutting the trees and working on the low water crossing.
Commissioners met with Mark Merrill, Emergency Management Director to discuss FEMA declaration. The 2020 EMPG grant ended June 2021 and we started a new grant on July 1 st . He is working on a grant for a generator.
Commissioners had a video zoom call with Allstate for Little Otter Creek. They discussed the intergovernmental agreement with Daviess County and a rental agreement for the lab with Allstate.
Commissioners called Dale Akey, board member of Caldwell County Extension Council, to discuss the agreement with the county for the lot that the new office will be place on.
Commissioners met with Terry Rumery to discuss economic development for the county.
Commissioners called Prosecuting Attorney Brady Kopek about a contract for the lot for the Extension Council.
Commissioners met with Sheriff Mitch Allen.
